DIRECTIONS : Please reword this and elaborate more on this discussion from my previous post. This is meant to be an update of a weekly learning. So please Phrase it as a learning subject and reword.

I learned some new and valuable information that expanded my knowledge on strategic management. The new material for this week pertained to the economic drivers of strategy positioning, threats to successful competitive positioning, and the industry life cycle. In regards to the economic drivers of strategy positioning, there are 2 different strategies for business: low-cost and differentiation. Within the drivers of low-cost advantage, there are 5 aspects that are important sources of potential cost advantage. According to Carpenter & Sanders (2008), “a successful low-cost strategy means that a firm is proficient at exploiting some of these drivers” (p. 140). The 5 factors are: economies of scale, diseconomy of scale, minimum efficient scale (MES), learning curve, and economy of scope. Within drivers of differentiation advantages, it involves one or more of the following product offerings: brand image, customization, unique styling, speed, more convenient access, and unusually high quality. The main goal of differentiation is to demand a price sufficient to do two things: 1) recoup the added costs of delivering the value added feature and 2) generate enough to profit to make the strategy worthwhile (Carpenter & Sanders, 2008).

Strategies are a vital component to finding success, however there are threats that occur when a firm is trying to find a successful competitive position in the industry. Under most circumstances, a successful strategic position must meet and satisfy two requirements: 1) It must be based on the firm’s resources and capabilities, and 2) it must achieve some level of consistency with the condition that prevails in the industry (Carpenter & Sanders, 2008). In regards to my learning on threats to successful competitive positioning, there are 4 different areas that firms must look at: low-cost, differentiation, focus, and integrated. Within the low-cost position, firms can face threats on new technology, inferior quality, social, political, and economic risk of outsourcing. In regards to differentiation positions, the threats that firms must look out for are: failing to increase buyers’ willingness to pay higher prices, underestimating costs of differentiation, over fulfilling buyers’ needs, and lower-cost imitation. . “A firm relying on a focus strategy may lose its advantage by attempting to grow and consequently attempt to meet the needs of too many customers. If that happens, a competitor or new entrant may then more successfully target the needs of the original focused group of customers” (Carpenter & Sanders, 2008, p. 150-151). ). Firms that try both to differentiate and to achieve a low-cost position will end up straddling two inconsistent positions. Although firms have succeeded in pursuing integrated strategies, it is still important for mangers to fully understand and know the tradeoffs they make when they opt for one position over the other.

The last aspect of my learning curve this week was on the industry life cycle. Conditions at different phases of an industry life cycle provide differential opportunities and constraints. There are 4 different stages of the industry life cycle: embryonic, growth, mature, and decline. In the embryonic phase it’s all about establishing a strong foundation of information for the customer. Within the growth stage, firms can increase their market share by taking advantage of footholds that were established early in the embryonic stage. The new technologies and changing industry competitive structure are the two main threats within the growth stage. As a firm, it is vital to make decisions about how the firm intends to grow. They determine the strategic vehicles that they’ll use to implement their preferred strategies (Carpenter & Sanders, 2008). ). In the maturity stage, products become more familiar to the customer. Product information is available for the customer to see, so that is why it’s important to have the right quality and services for the consumer. A mature market will increase the ability for firms to reap premium prices from differentiation stages. In regards to the decline stage, price competition can be intense, so containing costs is vital and firms with low-cost positions have an advantage. It is during this stage that firms need to consider the strategy of exiting the industry. According to Carpenter & Sanders (2008), exiting means “selling the company or certain divisions to competing firms” (p. 153). Although exiting signifies failure, it can be the best use of shareholders’ resources.

She also found a bloody survival knife and muddy boots under his bed, as well as a bracelet that said “Lynn.” A few days earlier, police had discovered the missing body of Jonas’ high school sweetheart, Lynn, in the woods. Lynn had recently broken up with him. The medical examiner had determined that Lynn had died from repeated stabbing. When Jonas had been questioned by the police at the station, he claimed he knew nothing of the incident, and the police have no evidence tying Jonas to the disappearance or murder. Analyze these facts using ethical concepts or concerns from Module 8. (You are not evaluating elements of murder, or due process issues for example.)

  2. District Attorney Schultz has brought charges against three players of the University football team. They have been charged with raping a stripper at a party attended by team members. The case has received much publicity and the media have discovered that the three players have a history of violence towards women. (Last year, two other women claimed they had been raped, but the cell phone video showing the forced sex had been excluded based on an illegal police search, and the players were found “not guilty.”) Shultz believes these players are guilty, and has given approximately 60 media interviews on the case. Schultz has also been campaigning for reelection, and a conviction here would go a long way. Unfortunately for Schultz, the DNA tests he ran do not match any of the three players to the victim’s assault. When he questioned her about this, the victim made contradictory statements, and she had no other evidence to corroborate the events. In fact, while her statements confirm that they raped her, she admitted to having consensual sex with two other men at the party, which weakens the case. Schultz decides to not tell anyone about the DNA results unless asked, and instructs the victim/witness to deny the other sexual encounters at trial. Analyze these facts using ethical concepts or concerns from Module 8. (You are not evaluating elements of rape or due process issues for example.) Assuming that Schultz had a strong belief that the defendants were guilty, include in your analysis whether this affects the moral and legal permissibility of his conduct.

  3. Michelle worked two jobs as a security guard in Phoenix, Arizona. She was walking outside the building where she works at 6:30 AM, Monday, when two bundles of money fell out of an armored truck en route to a bank. Inside the bundles was approximately $500,000. Michelle had an inheritance that would post to her bank account on Wednesday. She decides to take the day off and head to Las Vegas to play poker. Unfortunately, Michelle lost all of the money she gambled, but luckily, as expected, on Wednesday, her inheritance was paid. Michelle turned all of the $500,000 in to the FBI on Thursday morning, three days after finding it. Analyze these facts using ethical concepts or concerns from Module 8. (You are not evaluating elements of theft, conversion, or torts.) Include in your analysis whether Michelle was morally obligated to return the money. Should Michelle be penalized for using the money or for waiting three days to return the money?

The goals of this assignment are to provide a valuable skill and to assess your ability to comprehend and apply case law. Reading, briefing, and applying what you are reading in your textbook and learning in the modules are effective ways to become literate in the process of the U.S. legal system.

Conducting an Analysis

Before making and defending a decision, you must be familiar with the relevant law. For our purposes, your textbook and course material provide all the legal concepts needed to apply the law to a factual situation. Once you are familiar with the general content of the chapter, you should be able to recognize the issue involved in a case and find the legal concepts that will help you decide the case. For your reference, a sample analysis is provided at the end of this document.

First, you will read the assigned fact patterns (provided via a link in the module). Then, you will complete an analysis for all fact patterns presented. Each analysis should contain the following:

1. The main issue. Identify and write (in your own words, at least 50% original) the central issue to be decided. As much as possible, set the issue in legal terms and concepts.

2. Relevant legal concepts quoted from textbook court opinions. Search the assigned chapter for legal concepts that will help you decide and justify your decision. Once you find the quotations you wish to use, copy them into the appropriate places in your analysis.

3. Relevant case law quoted from the textbook.

4. Rationale. Write (in your own words, at least 50% original) a complete explanation about how you used the legal concepts you cited to make a decision about how the case should be resolved.

5. Ruling. Describe (in your own words, at least 50% original) what should happen to the parties involved as a result of your decision.

 I definitely agree that power tends to corrupt people if they allow the power to go to their head. Unfortunately when some people get in powerful positions they tend to engage in not so ethical powerful behavior such as: expecting others to do as they say without asking questions, believing the are above the law therefore they can break it, and showing lack of interest in the welfare of others amongst many other things. An example when power corrupts would be the leader of North Korea, Kim Jong-Un. He has zero disregard for the welfare of his people. Millions of his people are starving due to the lack of food, and he still has prison camps where people are starved and even beaten to death. The people in Korea fear him because he has the power to have them killed or thrown in prison camps.

  I do not think it’s ethical for bad leaders to try to increase their power especially if their values and rules do not coincide with what is ethically right versus what is ethically wrong.

Hello All,

I do that believe that power corrupts, and in that same sentence, I believe the level of corruption can also vary depending on the person.  I think power can and will go to anyone’s head to some degree.  We all like being in charge, being the leader, taking the responsibility for certain outcomes. 

These days it can be seen from as big as politicians to as small as the office veteran taking liberties at work.  For example, there is a person at my work place that is considered our “leader” when the real management steps out of office.  This person acquired this leadership position simply by being the longest working employee with the organization.  The person feels he can take the liberty’s to take extended lunches, to make decisions for the organization such as remodeling decisions, he feels he can tell the other workers what they need to do in and with their jobs in the organization. 

This type of corrupt leadership makes it harder for other employees, because we can’t look up to him as a good role model.  It makes work harder on us because at times he feels his “leadership” position exempts him from the regular work that we ALL usually do. 

Corrupt persons in leadership positions make it harder for the followers to want to do the right thing.  In a sense, they see leadership do it and think either, that’s the way it’s always been, or even worse, “Gee, I hope I can be like that guy one day”.

I agree that they should look at making sure Social Security is available to the next generation.  We all work and if we look at our check stubs, they take Social Security from us.  If they can take money out of my check each month, this should be something that I have access to in the future.  Yes many companies offer 401K plans, but I have seen where some businesses because of faulty planning and business failures, folks working for those companies for years, can lose those benefits.  So what does a person have to fall on? What happens if I work all my life putting money in a retirement plan, and because on nothing I have done, I loose all those saving?  Social Security should be available to me, as I know the amount of money put in it each I have worked clearly should be some help with living after working age.

I agree with this statement because congress should consider privatizing social security contributions which would help strengthen the link between work-effort and returns and would constitute a way to reduce such shortcomings. Privatization could also allow liberation of rigid age-eligibility rules-permitting workers greater flexibility to retire early if they have accumulated sufficient resources in their personal retirements accounts. Finally, privatization would provide a way of ensuring that resources intended for meeting future benefit obligations are saved and invested rather than being spent on non-Social Security government programs.
