RESOPND TO FOLLOWING STATEMENT:

First off, I applaud those whom been victimized and has the coverage to still speak up and report it. Majority of crimes that are committed will never be reported because the victim was too afraid, embarrassed, and humiliated to tell anyone what had happened to them.  I personally feel that self-reporting is vital to law enforcement serving and protecting the community and its citizens.  Law enforcement’s citizen:officer ratio is significantly high, having self-reporting citizens can greatly impact the crime rate in a positive way. I also feel that justice would be served (if law enforcement act accordingly). Although reporting crime online may be a critical positive tool, it may encourage some to file false police reports. However, I don’t feel that this crime would be significant enough to question the validity of the program. Do law enforcement not have to inquire these reports?

READ THE FOLLOWING CAREFULLY:

As I mentioned earlier in the day to you via telephone call, one of our insured, Kowalski’s Supermarket, has apparently been served with a civil complaint by one of its customers, known to us at this time only as “Maria” (we’ll get more details after the weekend from Mr. Kowalski), who is apparently a regular shopper at the store. The complaint against Kowalski’s centers around a recent shopping trip Maria made to the store, during which she asked for a particular product (a breakfast cereal) that was out of stock on the shelves. She expressed her dismay in a somewhat bothered fashion to Kowalski, who in turn immediately asked one of his employees, a stockboy by the name of Billy, to go to the rear stockroom to try to find a box of the product to bring back into the main retail space to give her.

  Billy took some undetermined amount of time to undertake a careful search for the product in the stockroom, which was apparently excessive for Maria. Ignoring warning signs on the stockroom doors which clearly indicated the space was for employees only, she pushed her shopping cart into the stockroom and confronted Billy verbally about the delay at that point. Maria saw the product for which she was looking in a nearby part of the stockroom and went to retrieve it, only to injure her ankle in a fall during her attempt to recover a box of it. Billy rushed to provide aid since it appeared Maria had been severely enough injured to be unable to stand or walk; she is claiming, however, that both the initial fall and Billy’s subsequent aid were both factors in her final injury. As a result of the injury, the complaint alleges, Maria was unable to go to a job interview she had immediately after the shopping trip and she subsequently lost that opportunity along with its appreciable fixed annual salary; she was also unable to return to her current employment as an aerobics instructor on an hourly rate at a nearby health club for a period of two months thereafter, and claims damages for loss of work, medical expenses and pain and suffering.

 I have been summoned to a meeting with representatives from Claims and Legal tomorrow, and although one of our attorneys will be there, I need to know the following ASAP so I may make a responsible recommendation about whether we should attempt to settle this matter or proceed to go to court with it (under our subrogation agreement with Kowalski’s, our company will defend Kowalski’s in court since it’s our money that will pay the plaintiff if she is successful on any claim). I need to know, specifically, (A) what tort claims plaintiff Maria may have against us, (B) what the legal elements of those claims are, and whether they’re intentional or negligent acts, (C) any legal defenses we have to those claims and (D) any counterclaims we may have against Maria to offset any potential liabilities Kowalski’s may have in this matter.

A few thoughts on Burn Care…

• You are a VERY-WELL recompensed consultant, hired by Mr. Warden the hospital CEO, to develop and analyze alternative strategies regarding the situation. Mr. Warden is the target audience for the report and presentation.
• As specified in the Case, “The corporation has a perfect Management Information System. I am providing you with the necessary data to solve the problems. Your job is to reduce operating expenses by $500,000 without reducing the quality of care or services to patients.
• You must also avert the nurses’ strike and maintain their long-term job satisfaction. You can implement any change, use any strategy to reduce your expenses. If your strategy involves capital expenditure, then it must be paid for with interest within three years by the additional savings in operating expenses.”
• For the Burn Care case your report should be the typical comprehensive “Capstone” report’ 15-pages single spaced report and these 15 pages not including charts, tables, or figures.

Let’s Review the Case

Job One –> The hospital was given a goal of reducing operating expenses by $500,000 for the burn care unit. (p. 2), based on 1994 hourly rates.

This is Larry’s favorite case, and there are a lot of ways to approach finding the reduction. But, you must not provide sub-standard patient care, and you want to prevent a nursing strike. Also, remember, you should be concerned about your continued ability to attract and retain qualified nurses – unless, that is, you want to get all of them from the agency pool (but are agency nurses as good, what about quality and continuity??).

A couple of more observations and/or subtleties I am concerned you might miss: Be careful

• On page 2, the case says –> In May 1993 Mr. Adams, the regional vice-president of the corporation and an accountant by training, wrote a letter to Mr. Warden, the CEO, that he should discontinue the Baylor Plan as it was costing about $800,000 more in nursing payroll. Obviously, IF Mr. Adams is correct, finding $500,000 in savings will be easy… right??? Or, is Mr. Adams just a stupid budget weenie in administration who doesn’t understand or even have a clue?? So, never ever say this in your solution.
• Remember, the “Budgeted Daily Staffing Pattern” (p. 4) is based on an assumption of 30 ADC, but what happens when ADC is higher/lower? How does the pattern change? And, remember, the budget model is based on the staffing standard of 22 HPPD.
• Pay attention to this paragraph –> The hospital’s budgeted nurse-staffing standard in 1996 was 22 hours per patient per day (HPPD). The staff nurses on the unit, however, generally complained that the staffing levels were not sufficient to provide quality care to the burn patients. In December 1996, the hospital implemented Medicus patient acuity
• Make sure you understand the work sampling data on page 5 🙂
• Make sure you understand the “Census and Acuity Data by Pay-Period” on page 3 🙂
• From page 6 –> Here we are assuming that only the regular staff makes overtime under the Baylor Plan. The Flex staff is generally a part-time staff and works 8- or 12-hour shifts without overtime but they receive benefits. Agency nurses do not earn overtime or benefits from the hospital.
• Obviously, regular employees are paid OT at 1.5x for hours worked over 40 in a week. If you suggest something besides the Baylor staffing model, make sure you are explicit about how that schedule will work for “regular” employees – 24×7 staffing is very, very hard and is typically not easily divisible by 40.
• What about sick leave, annual leave, etc. for regular employees. How does that fit in?

911 Dispatch receives a call on March 9, 2015, at 10:47PM from a female saying her husband is hurt. He has been stabbed in the back and his back is bleeding.

You arrive on scene at 11:05PM.

When you arrive, one patrol officer, Officer Julie Madsen, is on scene and was the first officer to arrive at 10:55PM.  When you arrive, paramedics are tending to a male victim who is lying on the floor in the kitchen. The male is wearing shorts and a t-shirt. Paramedics are preparing to transport the male to the hospital, Sanford Hospital in Fargo.

You are unable to interview the male because he is unconscious.

You see a woman in the home who is crying and very upset. You ask her to identify herself. She says her name is Lori Jackson. She tells you the male is her husband, Tom Jackson. She says he is 45 years old. You ask Lori her age and she says she is 45years old.  

You ask Lori a few questions before she leaves in the ambulance with Tom and the paramedics to go to the hospital.  

You ask Lori what happened to Tom. Lori says she got home around 10:00PM that night after having dinner with her friend,Sara Miller at Red Lobster, where they discussed their upcoming vacation to Florida. Lori says she last spoke with Tom about 5:30PM that day, when she was leaving work and he was leaving work. Tom works at Microsoft. Lori is a high school English teacher at Fargo South High School. Tom drives a black Ford pickup. Lori drive a black Ford Escape.  

Lori said that when she arrived home, she came into the home and found Tom lying on the floor in the kitchen. Lori’s breath has an odor of alcoholic beverage. You ask Lori who called 911. She says that she called 911, using Tom’s cell phone. The home does not have a land-line.  

You speak to the neighbor that lives to the west of the Jacksons; his name is Danny Jones. Danny works as a car salesman at Luther Ford in Fargo. Danny says he saw Lori drive into the driveway about 9:15PM. He saw her when he was walking out to get the mail. He knows it was about 9:15PM, because he was in the middle of watching the 9:00PM nightly news,which is half-hour show. Danny says Lori probably did not see him because he was just walking out his front door when she closed the garage door. Danny lives with his wife and three children, ages 5, 10, and 13. They have a golden retriever named Sadie.  

You ask Lori where her cell phone is and where Tom’s cell phone is. She states that she does not know where either her cell phone or Tom’s cell phone are; she cannot find them and does not know what she did with Tom’s cell phone after she called 911. Lori is upset, crying, and screaming. You have a difficult time understanding some of the words she is saying. She says she wants to get Tom to the hospital.  

You explore the home for any signs of evidence. You put on plastic gloves before you touch anything. 

Three drawers in the bedroom dresser are lying on the floor. There is a TV on the wall in the bedroom. The TV is on and on ESPN.

You look under the bed in the bedroom and find a fireplace poker. A large wedding picture is lying on the floor in the living room; glass is broken.

An office chair in the office/den has blood on the right arm of the chair and also on the floor by the desk. There is an open laptop sitting on the desk in the den/office. 

You see bloody footprints leading from the den/office into the kitchen to the location where Tom is found on the floor.  

Magazines are scattered on the floor in the living room. There is a glass coffee table in the living room with two brown recliner chairs.

You find a cell phone under the couch. As you touch the screen, the screen activates and you see a photo of what appears to be Tom hugging a female who does not look like Lori.  

You check all of the doors and windows and there does not appear to be any signs of forced entry. Nothing else seems to be disturbed in any of the rooms in the house.

There are no pets in the home. The couple does not have any children. No one else lives in the home. 

You take photographs of all rooms of the house.  You take fingerprints of the frame of the wedding photo, door handles and fireplace poker. You collect various pieces of evidence including the cellphone found under the couch, the fireplace poker,samples of blood from the footprints and samples of the blood found on the arm of the chair in the office/den.

You clear the scene at 3:45AM. You are the only police officer who looks for or collects evidence at the scene. You plan to follow up the case by contacting Lori’s friend, Sara. All evidence is taken to the police department and logged into the evidence room.
